In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – GDPR), César Jiménez Millán informs users of the application: BoostClass (hereinafter, the Application) about the processing of personal data that they voluntarily provide during the registration, access, and use of the service.
1. IDENTIFICATION OF THE DATA CONTROLLER
César Jiménez Millán, with CIF/NIF no.: 50472983N and address for notifications at Carretera de Toledo 16, P1, 2D, C.P. 28300 – Aranjuez (Madrid) (hereinafter, the Data Controller), is responsible for the processing of the data provided by the clients of the Application (hereinafter, the User(s)).
2. PURPOSE OF DATA PROCESSING
In order to register, access, and subsequently use the Application, the User must voluntarily provide personal data (mainly identification and contact information), which will be incorporated into automated systems owned by César Jiménez Millán.
The collection, storage, modification, structuring and, where applicable, deletion of the data provided by Users will constitute processing operations carried out by the Controller in order to guarantee the proper functioning of the Application, maintain the service and/or commercial relationship with the User, and for the management, administration, information, provision and improvement of the service.
The personal data provided by the User, especially the email address, may also be used to send newsletters as well as commercial communications regarding promotions and/or advertising related to the Application, provided that the User has previously given express consent to receive such communications electronically.
3. LEGAL BASIS
The processing of the User’s data is based on the following legal grounds:
• The request for information and/or contracting of the services of the Application, whose terms and conditions will be made available to the User in advance for explicit acceptance.
• The free, specific, informed and unambiguous consent of the User, through acceptance of this privacy policy via a declaration or clear affirmative action, such as checking a designated box.
If the User does not provide their data to César Jiménez Millán, or provides incorrect or incomplete data, it will not be possible to use the Application.
4. RETENTION OF PERSONAL DATA
The personal data provided by the User will be stored in the systems and databases of the Data Controller as long as the User continues using the Application and does not request its deletion.
In order to address possible liabilities arising from the processing, the data will be retained for a minimum period of five years.
5. RECIPIENTS
The data will not be communicated to any third party outside César Jiménez Millán, unless required by law or unless the User has previously given consent.
However, César Jiménez Millán may grant access to or transfer personal data provided by the User to third-party service providers with whom data processing agreements have been signed, and who will only access such information in order to provide services on behalf of the Data Controller.
6. DATA RETENTION (LOG DATA)
César Jiménez Millán informs the User that, as a provider of data hosting services and in accordance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), certain information will be retained for a maximum period of 12 months in order to identify the origin of hosted data and the moment when the service provision began.
The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or to safeguard public security, being made available to judges, courts or competent authorities when required.
Communication of data to State Security Forces and Bodies will be carried out in accordance with personal data protection regulations and with full respect for them.
7. PROTECTION OF HOSTED INFORMATION
The Data Controller adopts the necessary measures to guarantee the security, integrity and confidentiality of data in accordance with Regulation (EU) 2016/679.
Although the Controller performs backup copies of the content hosted on its servers, it is not responsible for the loss or accidental deletion of data by Users. Likewise, the Controller does not guarantee the full restoration of data deleted by Users if such data has been modified or removed since the last backup.
Services provided through the Application, except specific backup services, do not include restoration of content from backups when the loss is attributable to the User. In such cases, a fee may be determined based on the complexity and volume of recovery, subject to prior acceptance by the User.
Data restoration will only be included in the service price when the loss is due to causes attributable to the Data Controller.
8. EXERCISE OF RIGHTS
César Jiménez Millán informs the User that they have the right to access, rectification, restriction, erasure, objection, and data portability, which may be exercised by sending a request to the email address:
The User also has the right to withdraw previously given consent and to file complaints before the Spanish Data Protection Agency (AEPD).
9. ELECTRONIC COMMERCIAL COMMUNICATIONS
In accordance with the LSSI, César Jiménez Millán will not send advertising or promotional communications by email or any other equivalent electronic communication method unless they have been previously requested or expressly authorized by the recipients.
However, in the case of Users with whom there is an existing contractual, legal, or service relationship, the Controller may send commercial communications related to products or services similar to those initially contracted.
