Terms of Service & Data Processing Agreement

Welcome to BoostClass AI (provided by GoTeach). By activating a Free Trial or subscribing to our services, you agree to the following terms and conditions.

1. Object of the Service

GoTeach provides a trial access to the BoostClass AI platform for educational analysis. This trial is provided “as is” for evaluation purposes.

2. User Responsibilities

The User (Academy/Teacher) is solely responsible for:

• The content of the classes analyzed.
• Informing students about the use of BoostClass AI.
• Obtaining necessary consents from students (or legal guardians) for the recording and analysis of sessions.

3. Data Protection (GDPR Compliance)

3.1. GoTeach as Data Controller: GoTeach is the Controller for the User’s personal data (contact and billing info) and informs you that this data will be processed in accordance with Regulation (UE) 2016/679 (GDPR) and Spanish Law 3/2018 (LOPDGDD).

• Purpose: Execution of the contract/trial.
• Storage: Data will be kept for no longer than necessary to maintain the purpose of the treatment.
• Rights: You may exercise your rights of access, rectification, erasure, and portability via email: cesar.jimenezmillan@go-teach.ai.

3.2. GoTeach as Data Processor (Annex: Data Processing Agreement): When providing the BoostClass service, the Academy acts as Data Controller regarding its students’ and staff’s personal data; GoTeach acts as Data Processor.

• Guarantees: GoTeach implements appropriate technical and organizational measures to protect data subjects’ rights.
• No Storage of Audio/Video: BoostClass does not access, store, or host audio or video recordings. All recordings are controlled by the host (Zoom/Teams). GoTeach processes data in real-time or through temporary transcriptions to generate reports.
• Data Deletion: Temporary indicators are deleted automatically once the report is generated and delivered to the Academy.

4. Sub-processing and Transfers

The Academy authorizes GoTeach to use sub-processors (e.g., Microsoft Azure for cloud hosting) that comply with GDPR standards.

5. Limitation of Liability

GoTeach is not liable for any service interruptions caused by third-party platforms (Zoom, Microsoft Teams) or for the misuse of the analysis reports by the Academy.

6. Governing Law and Jurisdiction

This agreement shall be governed by Spanish law. For the resolution of any controversy, the Parties submit to the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction.
